These Terms of Service ("Terms") govern your use of Daily Nomad, operated by Daily Nomad ("we," "our," or "us"). By using our website at mydailynomad.com or our mobile application, you agree to these Terms.

1. Service Description

Daily Nomad is a web-based travel planning tool that generates personalized day-by-day itineraries. The service includes trip creation, activity recommendations, route optimization, collaborative planning, and booking links to third-party providers.

2. Account Requirements

• You must be at least 13 years old to create an account.
• You must provide accurate information during registration.
• You are responsible for maintaining the security of your account credentials.
• You may not share your account with others or create multiple accounts.

3. Subscriptions and Payments

• Daily Nomad offers a free tier and a paid Pro subscription.
• Pro subscriptions are billed monthly ($4.99/month) or annually ($39.99/year) and renew automatically.
• You can cancel your subscription at any time through the Stripe billing portal. Cancellation takes effect at the end of your current billing period.
• We do not offer refunds for partial billing periods. If you cancel mid-cycle, you retain access until the period ends.
• Prices may change with 30 days' notice. Existing subscribers will be notified before any price increase applies to their subscription.

4. User Content

• You own your trip data, including destinations, preferences, and itinerary selections.
• By using the service, you grant us a limited license to store, display, and process your trip data as needed to provide the service.
• You may not upload content that is illegal, harmful, or infringes on others' rights.

5. Prohibited Use

You agree not to:

• Use the service for any unlawful purpose
• Scrape, crawl, or use automated tools to extract data from the service
• Resell or redistribute generated itineraries commercially
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the service's infrastructure
• Use the service to send spam or unsolicited communications

6. Third-Party Services

Daily Nomad integrates with third-party services including Stripe (payments), Google (authentication and maps), Viator (booking links), and others. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the content, accuracy, or availability of third-party services.

7. Limitation of Liability

Daily Nomad is a planning tool. We are not responsible for:

• Accuracy of venue hours, availability, or pricing shown in itineraries
• Travel outcomes, including but not limited to venue closures, weather events, or booking issues
• Any losses arising from reliance on information provided by the service
• Actions of third-party services linked from the app (booking providers, payment processors, etc.)

To the maximum extent permitted by law, Daily Nomad's total liability to you for any claim arising from your use of the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that all information will be accurate.

9. Termination

• You may delete your account at any time by contacting support@mydailynomad.com.
• We may suspend or terminate accounts that violate these Terms or abuse the service.
• Upon termination, your data will be deleted within 30 days, except as required by law.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the revised Terms on this page with an updated date. Continued use of the service after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of North Carolina.
